2. Acceptance of Terms

By accessing and using PropertyAwgka ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using particular services of this Platform, you shall be subject to any posted guidelines or rules applicable to such services.

3. Description of Service

PropertyAwgka provides an online platform that connects property seekers with property owners, agents, and developers across Nigeria. Our services include but are not limited to:

• Property listings for sale and rent
• Property search and filtering capabilities
• User accounts for property seekers and agents
• Property listing submission for property owners and agents
• Communication tools between users

4. User Accounts

To access certain features of the Platform, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and complete information during registration

We reserve the right to suspend or terminate accounts that violate these terms or provide false information.

5. Property Listings

For Sellers and Agents:

• You must have the legal right to list any property on our Platform
• All information provided in listings must be accurate and truthful
• Property images must be actual photos of the listed property
• You must disclose any material facts about the property
• We reserve the right to remove any listing that violates these terms

For Buyers and Renters:

• Property listings are for informational purposes only
• You should verify all property details independently
• We do not guarantee the accuracy of property listings
• All transactions are between you and the property owner/agent

6. User Conduct

You agree not to use the Platform to:

• Post false, inaccurate, misleading, or fraudulent information
• Violate any Nigerian laws or regulations
• Infringe upon intellectual property rights
• Harass, abuse, or harm other users
• Upload viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Use automated systems to access or scrape the Platform

7. Intellectual Property

All content on PropertyAwgka, including but not limited to text, graphics, logos, images, and software, is the property of PropertyAwgka or its content suppliers and is protected by Nigerian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

8. Fees and Payments

PropertyAwgka may charge fees for certain services:

• Basic property listings are free
• Premium listing features may incur fees
• Agent and developer accounts may have subscription fees
• All fees are non-refundable unless otherwise stated
• We reserve the right to change our fee structure with notice

9. Third-Party Links

Our Platform may contain links to third-party websites. We are not responsible for the content or practices of these websites. Your use of third-party websites is at your own risk and subject to their terms and conditions.

10. Limitation of Liability

To the maximum extent permitted by law, PropertyAwgka shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Platform
• Any transactions conducted through the Platform
• Any property listings or content posted by users
• Unauthorized access to or alteration of your transmissions or data

11. Indemnification

You agree to indemnify and hold PropertyAwgka and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Akwa Ibom State, Nigeria.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
